The 24-year-old has a 2007 conviction for driving while under the influence of alcohol and drugs, and on Friday, Los Angeles County Superior Court Judge Stephanie Sautner ruled that the 24-year-old had violated her probation when allegedly stealing a US$2,500 (AUS$2,345) necklace from a Venice Beach jewellery store.

It is said that Lohan, who should have returned the necklace immediately after realising she had taken it, only did so after finding out LA Police was serving her with a search warrant.

The sentence would mark the fourth stint in jail for the troubled actress. However, Lohan’s lawyer has issued a statement saying she will appeal the sentence, although seen as a legal victory of sorts after Sautner had reduced the charge from a felony to a misdemeanour, significantly reducing the expected time spent in prison.

Prosecutor Danette Meyers, said Lohan deserves times in jail: “She continues to violate the law. She is not taking this seriously.”

Lohan is expected to be release on bail of US$75,000 (AUS$70,000)
